VPRAŠANJE 4: rok za dobavo prvih 41 merilnikov, ki je 15.11.2021, je izjemno kratek in praktično nedosegljiv že v normalnih pogojih, sedaj pa v časih covida še toliko težje. Prosimo, da podaljšate rok dobave vsaj za 4 mesece oziroma utemeljite zakaj tako kratek rok.

Rok za dostavo se ne more spremeniti oz. podaljšati.
Naročnik ima zagotovljena finančna sredstva za 41 dobavljenih merilnikov zgolj v letu 2021 in teh sredstev ne more prenašati v naslednje proračunsko leto.

The tender requires that the offer is signed with specific electron signatures which are only available for companies registeres with Slowenian tax-ID number. This is strictly in contradiction with EU directive 1999/93/EC which requires acceptance of any digital signature which complies with this directive and 1999/93/EU further requires that any additional requirement to the electronic signatures may not constitute an obstacle to cross-border services. With the given tender requirements it is not only an obstacle, it is nearly impossible for a non-Slowenian company to participate in the bid. May we therefore kindly ask to amend the tender requirements in a way that it is compliant to the mentioned EU directive.

V skladu s pojasnili upravljalca informacijskega sistema e-JN pa lahko ponudniki s sedežem v tujini oddajo ponudbo tudi z digitalnim potrdilom, ki ga je izdal eden izmed kvalificiranih overiteljev iz naslednjega seznama https://ccadb-public.secure.force.com/mozilla/CACertificatesInFirefoxReport. Pri tem so navodila za registracijo tujih ponudnikov v informacijskem sistemu e-JN dostopna na spletni strani https://ejn.gov.si/en/aktualno/vec-informacij-ponudniki.html.
Za naročnika je nebistveno, kdo je kvalificiran overitelj digitalnega potrdila (omejitve v zvezi s tem določa upravljavec informacijskega sistema e-JN). Določbe o digitalnih potrdilih je naročnik v razpisni dokumentaciji navedel kot napotek potencialnim ponudnikom, kako dostopati do informacijskega sistema e-JN in si zagotoviti pravočasno oddajo ponudbe.
V skladu z navedenim naročnik ne omejuje tujih ponudnikov pri oddaji ponudb v predmetnem postopku javnega naročanja. To vsekakor ni njegov namen, kar je mogoče sklepati tudi na podlagi naročnikovih dvojezičnih pojasnil o razpisni dokumentaciji, ki jih objavlja na nacionalnem portalu javnih naročil.

Komunikacijski protokol uporablja Protocol Buffers (Protobuf https://developers.google.com/protocol-buffers/docs/overview) za serializacijo sporočil, ki jih merilnik izmenjava s sistemom. Med redno komunikacijo je po protokolu vedno merilnik tisti, ki na interval odpre TCP/IP povezavo s centralnim vozliščem.
Struktura sporočila: Sporočilo se prične z številom tipa uint16, ki predstavlja velikost podatkovne sekcije v bajtih. Sledi mu podatkovna sekcija, serializirana s Protobuf.
Osnovni del podatkovne sekcije nosi identifikator akcije ActionID (enum TypeActionID), identifikator vozlišča UserID (sint32) in zaporedno številko sporočila v seriji FrameID (sint32). Temu sledijo dodatna polja, ki so specifična vsaki akciji.

Regarding the requirements of financial security for the seriousness of the tender, which must be enclosed in the offer the Contracting Authority does not require an original copy, but requires a bank guarantee in accordance with the Uniform Rules on Guarantees on Demand (EPGP), as described in point 22 of the tender docimentation.
Thus, the bank issues and signs the guarantee and forwards it to the bidder in PDF form, which is then electronically attached to the bid.

V zvezi z zahtevami glede finančnega zavarovanja za resnost ponudbe, ki mora biti priložena ponudbi, naročnik ne zahteva izvirnika, vendar zahteva bančno garancijo v skladu z Enotnimi pravili o garancijah na zahtevo (EPGP), kot je opisano v točki 22 razpisne dokumentacije.

Razpisni obrazec "PODATKI O PONUDNIKU" zahteva posredovanje podatkov, če ima ponudnik zastopnika v Sloveniji (zadnji odstavek oddelka 1), sodeluje pri javnem naročanju skupaj z drugimi podjetji (oddelek 2) ali sodeluje s podizvajalci (oddelek 3).
Ali je treba te razdelke odstraniti, če nič od navedenega ne drži? Ali kako natančno je treba te razdelke zapolniti?

In the tender documentation (form D / 1 - data on the bidder) - the part of item 1, where a bidder that does not have its registered office in the Republic of Slovenia is supposed to appoint a proxy/ representative for service of notices, is no longer relevant, as all decisions (including the contract award notice) are published on the public procurement portal. The decision shall be deemed to have been served on the day of its publication on the public procurement portal. Thus, foreign bidders do not need to provide information about their service representative.
All other points from form D / 1: point 2, point 3 (from 3 to 3.4) should be marked with the mark "N / A" (not applicalbe), if the bidder does not submit a joint bid (item 2) or subcontractors are not involved in the bid (items 3 to 3.4). this section can also be marked as irrelevant in some other way, from which it will be clear that they were not ignored and that they do not relate to the bid.

V razpisni dokumentaciji (obrazec D/1 - podatki o ponudniku) del tč. 1, kjer naj bi ponudnik, ki nima sedeža v Republiki Sloveniji, določil pooblaščenca za vročanje, ni več aktualna, saj se vse odločitve (tako tudi obvestilo o oddaji javnega naročila) objavi na portalu javnih naročil.
